Terms of Service — KathaKar

Welcome to KathaKar. By downloading, installing, or using the KathaKar mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and CreativeAndro ("we", "us", or "our"). By using the App, you represent that you are at least 13 years of age and have the legal capacity to enter into this agreement.

2. Account Registration

You must create an account to use the App. You may register using your email address or Google account.
You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activities that occur under your account.
You must provide accurate and complete information when creating your account.
You may not create an account on behalf of someone else without their permission.

3. Content Policy

KathaKar is a platform for sharing stories and poems. As a writer, you agree to the following content guidelines:

Prohibited Content — You must NOT publish:

Sexually explicit, pornographic, or adult content of any kind
Content that sexualizes, exploits, or harms minors in any way
Hate speech, content promoting violence, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or nationality
Content that threatens, intimidates, or bullies individuals or groups
Content that glorifies or promotes terrorism, extremism, or illegal activities
Spam, repetitive, or meaningless content
Content that infringes on copyrights, trademarks, or other intellectual property rights
Personal information of others without their consent (doxxing)
Misinformation or deliberately false content intended to deceive
Content containing malware, viruses, or harmful code

3.1 Content Moderation

We reserve the right to review, moderate, and remove any content that violates these Terms without prior notice. We may suspend or terminate accounts that repeatedly violate our content policy. Users may report inappropriate content using the "Report" button available on every story and poem.

3.2 Grievance Mechanism

In compliance with the Indian IT Act 2000 and IT (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021, we have established a grievance mechanism. Users can report content or file complaints by contacting our Grievance Officer at pramodsk1214@gmail.com. We will acknowledge complaints within 24 hours and resolve them within 15 days.

4. Intellectual Property

4.1 Your Content

You retain ownership of all stories, poems, and other content you create and publish on KathaKar. By publishing content on the App, you grant CreativeAndro a non-exclusive, royalty-free, worldwide license to display, distribute, and promote your content within the App.

4.2 Our Content

The App, including its design, features, and branding, is owned by CreativeAndro and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.

4.3 Copyright Infringement

If you believe content on the App infringes your copyright, please contact us at pramodsk1214@gmail.com with details of the allegedly infringing content. We will investigate and take appropriate action.

5. User Conduct

When using KathaKar, you agree not to:

Violate any applicable local, national, or international law or regulation
Impersonate any person or entity or misrepresent your affiliation with any person or entity
Harass, abuse, or harm other users
Attempt to gain unauthorized access to any part of the App or its systems
Use automated scripts, bots, or scrapers to access or interact with the App
Interfere with or disrupt the integrity or performance of the App
Attempt to reverse engineer or decompile the App
Use the App for any commercial purpose without our prior written consent

6. Advertising

KathaKar displays advertisements from Facebook Audience Network to support the free service. By using the App, you consent to the display of these advertisements. We do not control the content of third-party advertisements. You can manage your ad preferences through your device settings.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE APP IS AT YOUR SOLE RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CREATIVEANDRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Termination

We may suspend or terminate your account and access to the App at any time, without prior notice, if we believe you have violated these Terms. You may also delete your account at any time. Upon termination, your right to use the App will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in India.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the "Effective Date" at the top of this page. Your continued use of the App after changes constitutes acceptance of the modified Terms.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
